Are Ventura County Court Records Public?

Yes. Under the California Public Records Act (CPRA), Ventura County court records are deemed public. Section 6252(e) describes public records as writings containing information relating to the conduct of public business owned and maintained by any state or local government agency. Based on this, members of the public have a statutory right to access or obtain copies of case files handled within the county.

However, the Public Records Act permits record custodians to exercise discretionary power over records in situations where disclosure may result in an unreasonable invasion of personal privacy. Confidential court records are only available to parties with a direct interest. They must provide a government-issued ID. These exemptions are outlined in the California Trial Court Data Manual (TCRM) and Rule 8.47 of the California Court Rules. Records exempted from public disclosure include:

  • Medical records
  • Court arrest records of individuals acquitted in court.
  • Pre-sentencing diagnostic records
  • Juvenile records
  • Child custody evaluation records
  • Personal identifying information, such as Social Security Numbers and bank account details
  • Records that could constitute an unwarranted invasion of privacy

What Information is Available in Ventura County Court Records?

Depending on the particular case type, format, and status, Ventura County court records may contain different information. In-Person Access

Interested parties seeking Ventura County court records may visit the courthouse in person. They can get assistance from court staff to help locate files, search docket information, and view digital records. They can also use public terminals provided for case search. To facilitate the search, requesters must provide relevant information such as the name of the case party, case number, and filing date.

Mail and Phone Requests

Another avenue for record seekers to access case records is by mail or phone. They may call the Clerk of the Superior Court or mail in a written request to the office of the Clerk of the Superior Court. In their request, record seekers must indicate the case number, party name, and filing date. In addition, they must include the correct payment for the search fee and any copies with the request in advance. Requesters are required to provide a self-addressed stamped envelope for the copies to be returned by mail.

Fees for Court Records in Ventura County

Under California Government Code § 6253 and Rule 8.85, record custodians may charge limited fees to cover the cost of providing records upon a valid request. Standard copies of court documents are processed at $0.5 per page. Certified copies cost an additional $40. Record search costs $15 with a maximum of 15 names per request. Probate case filings and appeals cost $775.

Criminal Records Access in Ventura County

Interested parties can request their criminal records by submitting their fingerprints. Criminal history records processed by the California Department of Justice cost $25.

Ventura County Probate Records

Ventura County probate records are official documents that detail the adjudication of probate matters. These include guardianships, estate administration, marriage license applications, conservatorships, legal care arrangements, and treatment proceedings for individuals with mental health treatment needs. To access these records, interested parties may submit an application online, in person, or by mail to the clerk of the court.

Ventura County Family Court Records

Ventura family court records involve matters related to family relationships. These cases are handled by the Superior Court. Information contained in family court records includes divorce, child support and custody, domestic violence, paternity issues, guardianships, name change petitions, adoption, parental rights, annulment, and injunction for protection.

Due to the sensitive nature of family law cases, access to family court records is restricted. Moreover, some of these records, especially information involving minors, may be redacted. Also, certain records, like juvenile and adoption records, are often sealed or confidential. Such records are available to the record owners, their attorneys, individuals with a court order, government agencies with authority over family law records, researchers, and legal practitioners.

Record seekers may find family court records online through the Ventura County Superior Court case access portal. Alternatively, they may visit the courthouse in person on weekdays between 8 a.m. and 5 p.m. Visitors are advised to schedule an appointment ahead of time and pay the applicable fees to access Ventura County family court records.

Federal Court Records in Ventura County

For federal cases, such as civil, criminal, or bankruptcy cases that arise in Ventura County, the custodian of such records is the Clerk of Court for the US District Court for the Central District of California. The clerk maintains case files, dockets, and documents filed in the court. Federal court records available for access include:
